Why Potholes Form, and Why Rain Makes It Worse
Potholes generally start when water gets into a weakened area and traffic breaks the surface loose. Rainwater enters through cracks, softens the base, and a vehicle passing over finally breaks the surface out. In Cutler Bay, the National Weather Service in Miami counts May 15 to October 15 as the rainy season, and the county sits on porous limestone with a shallow water table, so there is plenty of moisture to work with. Filling only the hole leaves the weak spot underneath, which is why quick fixes so often fail.
Quick Patch or Proper Repair?
Not every pothole needs the same fix. FHWA-backed research (the SHRP pothole study) found that how well the work is done and the quality of the patching material matter more than the label on the method. A well-placed throw-and-roll patch with good material can last, while sloppy work in any method fails. For driveways and lots, the approach that removes the cause generally lasts longest.

What a Proper Pothole Repair Involves
- Assess the area. The visible hole is rarely the whole problem, so the pavement around it should be checked for cracking and soft spots.
- Remove the damaged asphalt. Damaged and loose asphalt is removed down to a solid base, along with water and debris.
- Repair the base. Weak or washed-out base material is addressed before any new asphalt goes in.
- Place and compact. New asphalt is laid and compacted so it is dense and flush with the surrounding surface, with no dip to collect water.
- Seal around it. Nearby cracks can be sealed so water does not find another way in.
Repairs come first, then sealcoating, so the finished surface looks and performs as one.
Patch It or Resurface the Lot?
- A few isolated potholes in otherwise solid pavement: patching is usually the right call.
- Repeated potholes in the same area: the base is likely failing, and a deeper repair is needed.
- Alligator cracking, flexing or standing water in many places: patch after patch stops making sense. Compare an overlay or new paving.

Property Owners and Managers: Potholes and Liability
A pothole in a lot is a trip, tire and complaint risk. Miami-Dade County's code compliance page says potholes on business, commercial and industrial property are regulated under County Code Section 19-15.3, which it describes as a limit of five square inches in size and two inches in depth, enforced on a complaint basis, with a courtesy warning before civil citations. Whether and how it applies to your property depends on your location and jurisdiction, so confirm with the county or your municipality. Either way, a lot with open potholes is easier to fix before a complaint than after.
